Who is responsible for processing your personal data?

ALTAIR NAUTICA SL is the RESPONSIBLE PARTY for processing the USER’s personal data and informs you that such data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR), and Organic Law 3/2018 of 5 December (LOPDGDD).

For what purposes do we process your personal data and why?

Depending on the form through which we have obtained your personal data, we will process it confidentially for the following purposes:

In the Contact form

  • To respond to enquiries or any type of request made by the user through any of the contact methods made available on the responsible party’s website.

  • To carry out statistical analyses and market research.

In the Reservations form

  • To process bookings at the responsible party’s establishment.

  • To send commercial and promotional communications by e-mail, fax, SMS, MMS, social networks or any other electronic or physical means, present or future, to customers, enabling commercial communications to be made regarding products or services similar to those initially contracted by the customer (Art. 21.2 LSSI).

For how long will we retain your personal data?

Data will be retained for no longer than is necessary to maintain the purpose of the processing, or for as long as statutory obligations dictate its retention, and once it is no longer necessary for that purpose, it will be deleted with appropriate security measures to ensure the anonymisation of the data or its total destruction.

To whom do we disclose your personal data?

No disclosure of personal data to third parties is envisaged unless, where necessary for the development and performance of the purposes of the processing, to our communications service providers, with whom THE RESPONSIBLE PARTY has entered into the confidentiality and data processing agreements required by the applicable privacy regulations.

What are your rights?

The USER’s rights are as follows:

  • Right to withdraw consent at any time.
  • Right of access, rectification, portability and erasure of your data, and to restriction of or objection to its processing.
  • Right to lodge a complaint with the supervisory authority (www.aepd.es) if you consider that the processing does not comply with applicable regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE
USER

USERS, by ticking the relevant boxes and entering data in the fields marked with an asterisk (*) in the contact form or presented in download forms, expressly and freely and unambiguously accept that their data is necessary to attend to their request by the provider, it being voluntary to include data in the remaining fields. THE USER guarantees that the personal data provided to THE RESPONSIBLE PARTY is accurate and undertakes to notify any modifications thereto.

THE RESPONSIBLE PARTY informs you that all data requested through the website is mandatory, as it is necessary for the provision of an optimal service to THE USER. In the event that not all data is provided, it cannot be guaranteed that the information and services provided will be completely suited to your needs.

3. SECURITY MEASURES

In accordance with the provisions of the applicable personal data protection regulations, THE RESPONSIBLE PARTY is complying with all provisions of the GDPR and LOPDGDD regulations for the processing of personal data under its responsibility, and manifestly with the principles described in Article 5 of the GDPR, under which data is processed lawfully, fairly and transparently in relation to the data subject and is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed.

THE RESPONSIBLE PARTY guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established by the GDPR and LOPDGDD in order to protect the rights and freedoms of USERS and has communicated appropriate information to them so that they can exercise those rights.

SOCIAL MEDIA PRIVACY POLICY

ALTAIR NAUTICA SL, hereinafter THE RESPONSIBLE PARTY, informs THE USER that it has created profiles on the social networks Facebook, Instagram, Twitter, LinkedIn, Youtube, Vimeo and Google+, that it is responsible for processing the personal data of users carried out on those social networks, and informs you that such data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR), and Organic Law 3/2018 of 5 December (LOPDGDD), for which reason the following processing information is provided:

For what purposes do we process your personal data?

Purpose of the processing: to maintain a relationship between THE USER and THE RESPONSIBLE PARTY which may include the following operations:

  • Processing requests and enquiries submitted to the responsible party
  • Providing information about activities and events organised by the responsible party
  • Providing information about products or services offered by the responsible party
  • Interacting via official profiles

For what reason may we process your personal data?

Legal basis for processing: Article 6.1.a GDPR; the data subject has given their consent to the processing of their personal data for one or more specific purposes. THE USER has a profile on the same social network and has decided to join THE RESPONSIBLE PARTY’s social network, thereby expressing an interest in the information published on it; therefore, at the moment of requesting to follow our official profiles, they provide us with their consent to the processing of the personal data published on their profile.

THE USER may access the privacy policies of the social network itself at any time, as well as configure their profile to ensure their privacy.

THE RESPONSIBLE PARTY has access to and processes the USER’s public information, in particular their contact name. This data is only used within the social network itself and will only be incorporated into a file held by THE RESPONSIBLE PARTY when necessary to process THE USER’s request.

Data retention criteria: data will be retained for as long as THE USER does not revoke the consent given, as indicated in this privacy policy.

To whom do we disclose your personal data?

Data disclosure: information provided by THE USER through THE RESPONSIBLE PARTY’s social networks, including personal data, may be published, always depending on the services THE USER uses, and may therefore be made publicly available to other third-party users of the social networks. From the profile of each social network, THE USER can configure what information they wish to make public in each case, view the permissions that have been granted, remove or deactivate them, as with any third-party application they no longer wish to use.

No disclosure of personal data to third parties outside the social network is envisaged unless, where strictly necessary for the development and performance of the purposes of the processing, to our communications service providers, with whom THE RESPONSIBLE PARTY has entered into the confidentiality and data processing agreements required by applicable privacy regulations.

Rights available to THE USER: these may only be satisfied in relation to information under the control of THE RESPONSIBLE PARTY.

2. USE OF THE PROFILE

THE RESPONSIBLE PARTY will carry out the following actions:

  • Access to public profile information
  • Publication on THE USER’s profile of all information already published on THE RESPONSIBLE PARTY’s social network
  • Sending personal and individual messages via the social network’s channels
  • Page status updates which will be published on THE USER’s profile

THE USER may always control their connections, delete content that no longer interests them and restrict who they share their connections with; to do so they will need to access their privacy settings.

3. PUBLICATIONS

Once THE USER is following or has joined THE RESPONSIBLE PARTY’s social network, they may publish comments, links, images, photographs or any other type of multimedia content supported by it. THE USER must in all cases be the holder of the published content, hold copyright and intellectual property rights, or have the consent of the affected third parties.

Any publication on the social network, whether texts, graphics, photographs, videos, etc., that attacks or may be liable to attack morality, ethics, good taste or decency, and/or that infringes, violates or breaches intellectual or industrial property rights, the right to one’s image or the law, is expressly prohibited.

In such cases, THE RESPONSIBLE PARTY reserves the right to immediately remove the content without prior notice, and may request the permanent blocking of THE USER.

THE RESPONSIBLE PARTY shall not be liable for content freely published by a USER.

THE USER should bear in mind that their publications will be visible to other users, meaning they are primarily responsible for their own privacy.

Images that may be published on the social network will not be stored in any file by THE RESPONSIBLE PARTY, but will remain on the social network.

4. DATA OF MINORS OR PERSONS WITH SPECIAL NEEDS

Access to and registration via THE RESPONSIBLE PARTY’s social networks is prohibited for persons under the age of 18. Where THE USER has special needs, the intervention of the holder of parental authority or legal guardianship, or of their legal representative by means of a valid document evidencing representation, will be required.

THE RESPONSIBLE PARTY shall be expressly exempt from any liability arising from the use of social networks by minors or persons with special needs. THE RESPONSIBLE PARTY’s social networks do not knowingly collect any personal information from minors; accordingly, if THE USER is a minor, they must not register, use THE RESPONSIBLE PARTY’s social networks, or provide any personal information.
