E-COMMERCE (SERVICES). GENERAL TERMS AND CONDITIONS OF CONTRACT

Introduction

This contractual document governs the General Terms and Conditions for the contracting of services (hereinafter, the «Conditions») through the website www.ibizajetskibeach.com, owned by ALTAIR NÁUTICA S.L., which markets its services under the trade name IBIZA JET SKI BEACH, hereinafter ALTAIR NÁUTICA S.L., whose contact details also appear in the Legal Notice of this Website.

These Conditions will remain published on the website and available to the CLIENT so that they may be reproduced and saved as confirmation of the contract. They may be amended at any time by ALTAIR NÁUTICA S.L. It is the CLIENT’s responsibility to read them periodically, since the Conditions in force at the time the bookings are made are the ones that apply.

Contracts are not subject to any formality other than the cases expressly set out in the Spanish Civil and Commercial Codes and in this or other special laws.

Acceptance of this document means that the CLIENT:

Has read, understands and comprehends what is set out herein.
Is a person with sufficient legal capacity to enter into a contract.
Assumes all the obligations set out herein.

These conditions are valid for an indefinite period and apply to all bookings made through the website of ALTAIR NÁUTICA S.L.

ALTAIR NÁUTICA S.L. states that the business is responsible and aware of the legislation in force, and reserves the right to unilaterally amend these conditions, without this affecting the terms and conditions accepted prior to the amendment.

IDENTITY OF THE CONTRACTING PARTIES

On the one hand, ALTAIR NÁUTICA S.L., the PROVIDER of the services contracted by the CLIENT, with registered office at Calle Sant Jaume, Nº 39, 4-1, 07840 Santa Eulalia del Río (Illes Balears), tax number (NIF) B07820509 and customer service telephone +34 633 75 06 63.

ALTAIR NÁUTICA S.L. markets its services under the trade name IBIZA JET SKI BEACH.

And on the other, the CLIENT, who makes a booking or contracts a service through the different sales channels available, and who is responsible for the accuracy of the personal data provided to ALTAIR NÁUTICA S.L.

PURPOSE OF THE CONTRACT

The purpose of this contract is to regulate the contractual relationship between ALTAIR NÁUTICA S.L. and the CLIENT which arises at the moment the CLIENT accepts the corresponding box during the booking process.

The contractual relationship entails the provision, in exchange for a specific price publicly displayed on the website, of the specific service selected by the CLIENT.

The services may include guided jet ski tours, self-drive jet ski rental and other nautical services offered under the trade name Ibiza Jet Ski Beach.

CORRECTION OF DATA

Should the CLIENT identify errors in the data published on the website or in the documents generated by the contractual relationship, they may report this to info@ibizajetskibeach.com so that ALTAIR NÁUTICA S.L. can correct them as soon as possible.

The CLIENT is responsible for providing correct, complete and up-to-date personal, contact and booking details.

BOOKING PROCEDURE

In order to access the services offered by ALTAIR NÁUTICA S.L., the CLIENT must provide the data requested during the booking process.

A user account is not required when the booking system allows the booking to be made directly.

The CLIENT must freely and voluntarily provide the personal data requested, which will be processed in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and Spanish Organic Law 3/2018 of 5 December (LOPDGDD), as detailed in the Legal Notice and the Privacy Policy of this website.

Once the booking procedure has begun, the CLIENT will be informed of the conditions applicable to the selected activity.

The booking procedure comprises:

General contracting clauses.
Activation and provision of services.
Right of withdrawal, where legally applicable.
Complaints.
Force majeure.
Jurisdiction.
General terms of the offer.
Price and period of validity of the offer.
Additional costs, where applicable.
Method of payment, charges and discounts.
Purchase process.
Severability and suspension or termination of the contract.
Guarantees, modifications and refunds.
Applicable law and jurisdiction.

1. GENERAL CONTRACTING CLAUSES

Unless otherwise agreed in writing, placing an order or making a booking with ALTAIR NÁUTICA S.L. implies the CLIENT’s acceptance of these legal conditions.

No stipulation made by the CLIENT may differ from those of ALTAIR NÁUTICA S.L. unless expressly accepted in advance and in writing by ALTAIR NÁUTICA S.L.

The particular conditions displayed during the booking process may supplement these General Conditions.

In the event of a contradiction between a particular condition expressly indicated for an activity and these general conditions, the particular condition prevails for that booking.

2. ACTIVATION AND PROVISION OF SERVICES

ALTAIR NÁUTICA S.L. will not activate or confirm any service until it has verified that payment has been correctly made, where such payment is required to confirm the booking.

Once the booking is confirmed, the CLIENT will receive the information needed to take part in the activity.

The booking confirmation may include:

Activity booked.
Date.
Time.
Departure point.
Meeting point.
Number of participants.
Price.
Booking reference.
Specific instructions.
Additional information needed to take part in the activity.

The CLIENT must check the information received and report any error to ALTAIR NÁUTICA S.L. as soon as possible.

Should it be impossible to provide the contracted service for reasons attributable to ALTAIR NÁUTICA S.L., the CLIENT will be informed and offered, as appropriate, an alternative, a change of date or a refund of the amount paid.

3. RIGHT OF WITHDRAWAL

Where legally applicable, the CLIENT has the right of withdrawal provided for in article 102 of Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws.

However, in accordance with article 103 of Royal Legislative Decree 1/2007, the right of withdrawal does not apply to those contracts for which the regulations establish an exception.

In particular, certain leisure-related services with a specific date or period of performance may be excluded from the general right of withdrawal.

The cancellation conditions specifically established for the activities of ALTAIR NÁUTICA S.L. are those set out in these Conditions and, where applicable, during the booking process.

4. COMPLAINTS AND DISPUTE RESOLUTION

Any complaint the CLIENT deems appropriate will be dealt with by ALTAIR NÁUTICA S.L. as soon as possible.

Where possible, the CLIENT should provide the booking number, the name of the booking holder, the date of the activity and a description of the incident.

Complaints and disputes will be handled in accordance with the applicable consumer protection legislation.

5. FORCE MAJEURE

The parties will not incur any liability for any failure to perform due to force majeure. Performance of the obligation will be delayed or adapted until the force majeure event ceases, where this is possible.

Nautical activities are particularly affected by weather and sea conditions, including rain, wind, sea state, weather warnings, navigation restrictions, instructions from the competent authorities and other safety-related circumstances.

There may also be social or operational circumstances such as demonstrations, strikes, access restrictions, instructions from the authorities or other circumstances beyond the control of ALTAIR NÁUTICA S.L.

In such cases, ALTAIR NÁUTICA S.L. may slightly modify the content, route, timetable or manner of provision of the bookings when unforeseen circumstances make it impossible to provide the activity exactly as initially planned.

ALTAIR NÁUTICA S.L. will endeavour to provide the service in the best possible way, and may replace those elements that cannot be enjoyed with others of similar purpose and value where possible.

When an activity must be cancelled for safety reasons and cannot be rescheduled, the corresponding cancellation and refund policy will apply.

6. JURISDICTION

The CLIENT may not assign, transfer or pass on to third parties the rights, responsibilities and obligations arising from the booking without the authorisation of ALTAIR NÁUTICA S.L., except where such assignment is legally permitted.

If any provision of these conditions is deemed null or impossible to fulfil, the validity, legality and fulfilment of the remainder will not be affected.

The CLIENT declares that they have read, understood and accepted these Conditions in their entirety.

7. GENERAL TERMS OF THE OFFER

All sales and bookings made by ALTAIR NÁUTICA S.L. are deemed to be subject to these Conditions.

No modification, alteration or agreement contrary to the commercial proposal of ALTAIR NÁUTICA S.L. or to the provisions set out herein will have any effect, unless expressly agreed in writing.

Given the continuous technical advances and service improvements, ALTAIR NÁUTICA S.L. reserves the right to modify the specifications of its services with respect to the information provided in its advertising, provided that such modification does not substantially affect the service contracted.

When an operational, technical, weather or safety circumstance prevents an activity from being provided exactly as initially planned, ALTAIR NÁUTICA S.L. may make the reasonable modifications needed to guarantee the correct and safe provision of the service.

8. PRICE AND PERIOD OF VALIDITY OF THE OFFER

The prices indicated for each service include VAT or any other applicable taxes, unless expressly stated otherwise.

The prices applicable to each service are those published on the website and are expressed in euros.

Before completing the purchase, the CLIENT can check all the details of the quotation: service selected, quantity, price, availability, charges, discounts, taxes and purchase total.

Prices may vary as long as the order has not been placed.

Once the order has been placed and payment confirmed, the price of the booking is fixed, unless there is an obvious error or a modification subsequently requested by the CLIENT.

Every payment made to ALTAIR NÁUTICA S.L. will be invoiced in accordance with the applicable tax regulations.

ACTIVITIES AND DEPARTURE POINTS

The activities marketed under the Ibiza Jet Ski Beach brand are currently offered from:

Puerto de San Antonio
Cala de Bou
Cala Bassa

The availability, duration, timetable, route and price of each activity depend on the departure point selected and on the availability at the time of booking.

The website shows the CLIENT the options available for the date and departure point selected.

GUIDED JET SKI TOURS

ALTAIR NÁUTICA S.L., under the trade name Ibiza Jet Ski Beach, offers different guided jet ski tours along the coast of Ibiza.

The experiences currently available include:

Es Vedrà Island.
Margarita Island.
Atlantis.
Heaven’s Door.
Portixol.
Cala Conta.
Cala Tarida.
Cala Salada.
Jet Ski Circuit.

The durations and prices of these activities may vary depending on the departure point selected.

The specific information for each activity is that shown on its corresponding booking page and during the booking process.

Prices may be displayed as “from” prices, as they may vary according to departure point, date, duration, availability and applicable promotions.

DURATION OF THE ACTIVITIES FROM PUERTO DE SAN ANTONIO

On tours departing from Puerto de San Antonio, the duration indicated for the activity corresponds to the total time of the experience, including both the jet ski riding time and the speedboat transfer time between the port and the jet ski departure point, and the corresponding return.

For this reason, activities departing from Puerto de San Antonio may have a longer total duration than the jet ski riding time of the same experience from other departure points.

The jet ski riding time for each tour remains in line with the specific characteristics of the activity booked.

The remaining time up to the total advertised duration corresponds to the speedboat transfer.

The speedboat transfer is an integral part of the experience booked and is included in the price of the activities departing from Puerto de San Antonio.

The total published duration is approximate and may vary slightly due to navigation conditions, sea state, maritime traffic, boarding, disembarking and other operational or safety circumstances.

On activities departing from Cala Bassa or Cala de Bou, the published duration corresponds to the duration of the activity booked from that departure point, not including the speedboat transfer from Puerto de San Antonio.

WHAT THE GUIDED TOURS INCLUDE

Unless expressly stated otherwise in the description of a specific activity, the guided tours include:

Qualified instructor.
Safety briefing.
Necessary safety equipment.
Life jacket.
Fuel needed for the route booked.
Insurance corresponding to the activity.
A stop for swimming when conditions allow.
The possibility of snorkelling when conditions allow.
Time for photographs when safety conditions allow.
Speedboat transfer when the activity departs from Puerto de San Antonio.

The specific services included are those indicated on the information page of each activity.

AGE AND PARTICIPATION

For guided tours:

The rider must meet the minimum age established for the activity.
Minors may take part as passengers provided they meet the age, height and safety conditions established by ALTAIR NÁUTICA S.L.
The minimum height currently established for minors travelling as passengers is 120 cm.
Minors must present the corresponding authorisations where these are required.
Each jet ski may carry a maximum of two people, unless expressly stated otherwise.

ALTAIR NÁUTICA S.L. may request documentation proving age and identity.

9. TRANSPORT COSTS

There are no additional transport costs for the speedboat transfer included in the activities departing from Puerto de San Antonio.

When an activity includes a speedboat transfer, this is an integral part of the service booked and is included in the price published for that activity.

10. METHODS OF PAYMENT, CHARGES AND DISCOUNTS

ALTAIR NÁUTICA S.L. is responsible for the financial transactions and enables the payment methods available during the booking process.

The methods available may include:

Credit or debit card.
Other payment methods that may be enabled during the booking process.

The CLIENT may use a coupon or discount code when it has been provided by ALTAIR NÁUTICA S.L. and is still valid.

Promotions are subject to the particular conditions established for each campaign.

When the booking is made, 100% of the price of the activity may be charged, unless a different condition is established during the booking process.

When the booking is cancelled within the established deadlines, the corresponding amount will be refunded in accordance with the applicable cancellation policy.

Security measures

The website uses information security techniques that are generally accepted in the industry, such as SSL, secure pages, firewalls, access control procedures and cryptographic mechanisms, in order to prevent unauthorised access to data.

ALTAIR NÁUTICA S.L. undertakes not to allow any transaction that is illegal or contrary to the applicable rules of financial institutions or credit card brands.

SELF-DRIVE JET SKI RENTAL

ALTAIR NÁUTICA S.L. also offers a self-drive jet ski rental service, without an accompanying instructor.

This option is different from the guided tours and requires compliance with the legal and contractual requirements established for independent navigation.

Requirements

In order to rent a self-drive jet ski, it is compulsory to:

Hold a valid nautical licence or qualification sufficient for the corresponding navigation.
Present valid identification documents.
Meet the applicable minimum legal age.
Sign the rental agreement.
Attend the compulsory safety briefing.
Accept the conditions of use.
Make the corresponding payment.
Pay the established security deposit.

ALTAIR NÁUTICA S.L. may check the validity and sufficiency of the qualification presented before authorising departure.

DURATION AND PRICE OF SELF-DRIVE RENTAL

The rental options currently available include:

1 hour: €200 per jet ski.
2 hours: €350 per jet ski.
4 hours: €450 per jet ski.

Prices may be modified for future bookings.

The applicable price is the one confirmed during the booking process.

The rental currently includes one tank of fuel.

RENTAL SECURITY DEPOSIT

Self-drive rental requires a security deposit of between €1,000 and €2,000 per jet ski, depending on the duration of the rental and the particular conditions of the booking.

The exact amount will be communicated to the CLIENT before or during the booking process.

The purpose of the security deposit is to guarantee compliance with the lessee’s obligations and to cover, where appropriate:

Damage to the jet ski.
Damage to the engine.
Damage to the hull and deck.
Damage to the propeller.
Damage to the turbine.
Damage to the propulsion system.
Damage to mechanical components.
Damage to or loss of accessories.
Loss or theft of the jet ski.
Recovery or towing costs.
Costs arising from grounding or running aground.
Costs arising from improper navigation.
Additional fuel where applicable.
Other damage or costs attributable to the lessee under the agreement.

The security deposit does not constitute a maximum limit of liability.

When the cost of the damage or expenses attributable to the lessee exceeds the amount of the security deposit, ALTAIR NÁUTICA S.L. may claim the corresponding difference in accordance with the applicable legislation.

CONDITION OF THE JET SKI

The condition of the jet ski will be checked before delivery.

Where necessary, ALTAIR NÁUTICA S.L. may document that condition by means of photographs, videos or other means.

The CLIENT must report any damage or anomaly detected before starting navigation.

A further check will be carried out on return.

Damage not recorded in the initial inspection that appears during or after the rental period may be charged to the CLIENT where their responsibility is established.

RIDER’S LIABILITY DURING THE RENTAL

During the self-drive rental period, the rider is responsible for the jet ski from the moment it is handed over until it is returned and accepted by ALTAIR NÁUTICA S.L.

The rider must:

Use the jet ski prudently and responsibly.
Comply with maritime regulations.
Respect the authorised navigation areas.
Respect speed limits.
Maintain safety distances.
Respect swimming areas.
Follow the instructions of ALTAIR NÁUTICA S.L.
Avoid any dangerous manoeuvre.
Use the jet ski solely for the purpose for which it was designed.

The rider is liable for damage arising from negligent, careless or reckless use, or use contrary to the instructions received, under the terms established by the applicable legislation.

DAMAGE TO THE ENGINE, HULL AND PROPULSION SYSTEM

The CLIENT is liable for damage caused during the rental period when it results from their actions, negligence, recklessness, failure to follow instructions or improper use.

This includes, among others:

Damage to the hull and deck.
Damage to the engine.
Damage to the propeller.
Damage to the turbine.
Damage to the propulsion system.
Damage caused by objects entering the intake or propulsion systems.
Damage arising from navigation in waters of insufficient depth.
Damage from contact with rocks, sand, ropes or other obstacles.
Damage from grounding or running aground.
Damage to accessories or equipment.

NAVIGATION IN RISK AREAS

It is prohibited to deliberately navigate in areas of insufficient depth or to approach rocks, beaches, seabeds, swimming areas or obstacles in a way that may cause damage to the jet ski.

The rider must keep a sufficient safety distance from the coast, bathers, vessels, nautical installations and any obstacle.

GROUNDINGS, RUNNING AGROUND AND RECOVERY

In the event of grounding, running aground or immobilisation of the jet ski due to an action attributable to the rider, the rider is liable for the reasonable costs directly arising from the incident, including:

Assistance.
Towing.
Recovery.
Transport.
Cleaning.
Inspection.
Repair.
Other costs directly related to the incident.

ALTAIR NÁUTICA S.L. may apply the security deposit to such costs where appropriate.

LOSS, ABANDONMENT OR THEFT OF THE JET SKI

The rider is responsible for the jet ski throughout the entire rental period.

It is prohibited to:

Abandon the jet ski without authorisation.
Hand it over to an unauthorised person.
Allow an unauthorised person to ride it.
Sublet or assign it.
Use it for activities other than those contracted.
Use it for illegal activities.

When the loss, abandonment or theft is the result of an action attributable to the rider, the rider is liable for the corresponding damage and costs in accordance with the applicable legislation and the rental agreement.

PROHIBITION ON ASSIGNING THE RENTAL

The jet ski may only be ridden by the person or persons previously authorised who meet the legal requirements.

It is prohibited to lend, assign or sublet the jet ski to third parties.

Unauthorised assignment constitutes a breach of contract.

ALCOHOL, DRUGS AND RISKY BEHAVIOUR

It is prohibited to ride a jet ski under the influence of alcohol, drugs or any substance that may affect riding ability.

ALTAIR NÁUTICA S.L. may prevent departure or end the rental when there are reasonable grounds to believe that the rider is not in a fit condition to navigate.

When the cause is attributable to the CLIENT, early termination does not give rise to any right to a refund, without prejudice to legally recognised rights.

INSURANCE

ALTAIR NÁUTICA S.L. holds the insurance legally required and applicable to the different types of service.

For self-drive rental, the activity has the corresponding civil liability insurance.

The existence of civil liability insurance does not mean that all damage to the jet ski itself is covered, nor does it remove the lessee’s obligations arising from damage caused by their actions where this applies legally and contractually.

The cover, limits, exclusions and excesses are those established in the corresponding policy.

11. PURCHASE PROCESS

Basket / quotation simulation

Any service in our catalogue may be added to the basket or to the booking system where this functionality is available.

The booking process displays the services selected, quantities, price, taxes, discounts and the total amount.

The quotation simulation does not constitute a commitment until the CLIENT completes the booking and payment process.

The booking system proceeds as follows:

Verification of the billing details.
Selection of the activity.
Selection of the date.
Selection of the time.
Selection of the departure point.
Entry of the required data.
Selection of the payment method.
Completion and confirmation of the booking.

Once the booking has been processed, the system sends the CLIENT an email with the confirmation, the booking reference and the information needed to take part in the activity.

The CLIENT must check that information.

The meeting point and the information needed to take part in the activity are communicated in the booking confirmation or voucher.

12. SEVERABILITY AND SUSPENSION OR TERMINATION OF THE CONTRACT

If any of these terms and conditions is deemed illegal, null or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of the remaining conditions.

ALTAIR NÁUTICA S.L. may suspend or terminate the provision of a service where there is valid cause, including the CLIENT’s breach of the obligations established in this document, in the rental agreement or in the applicable regulations.

In the case of activities in progress, ALTAIR NÁUTICA S.L. may end the activity when this is necessary to guarantee the safety of the participants, the staff, third parties or the vessel.

13. GUARANTEES, MODIFICATIONS AND REFUNDS

Guarantees are governed by Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users, and by other applicable regulations, in so far as these apply to the nature of the services contracted.

Booking modifications

The CLIENT may request modifications to the date, time, departure point, activity or number of participants.

Modifications are subject to availability.

Requests must be made through verifiable means at:

Modifications made sufficiently in advance may be carried out at no additional cost where there is availability and the modification does not involve a change in price.

When the change involves a different price, the price corresponding to the new booking applies.

BOOKING CANCELLATION

Unless a specific activity expressly states different conditions, ALTAIR NÁUTICA S.L. currently allows free cancellation up to 24 hours before the scheduled time of the activity.

Cancellations made less than 24 hours in advance may be subject to the total loss of the amount paid.

Failure by the CLIENT to turn up (no-show) is considered a cancellation outside the established period and does not give rise to any right to a refund, unless another solution applies by law.

If an activity has a particular cancellation policy, this will be stated in the offer, during the booking process and/or in the booking receipt or voucher.

Group bookings

For group bookings, ALTAIR NÁUTICA S.L. may establish particular cancellation, modification and payment conditions.

Where special conditions apply to a group booking, these will be communicated to the CLIENT during the booking process and will prevail for that booking.

CANCELLATION DUE TO WEATHER OR SAFETY CONDITIONS

When an activity has to be cancelled by ALTAIR NÁUTICA S.L. due to weather conditions, sea state, navigation restrictions, instructions from the authorities or any other safety-related circumstance, the following will be offered depending on the circumstances and availability:

Change of date.
Change of time.
An alternative activity where possible.
A refund when the activity can neither be carried out nor rescheduled.

The decision to cancel or modify an activity for safety reasons rests with ALTAIR NÁUTICA S.L. and with the staff responsible for the activity.

External or indirect costs incurred by the CLIENT, such as travel, accommodation, flights, taxis or vehicle rental, will not be compensated when the activity is modified or cancelled due to the circumstances indicated above, unless the law provides otherwise.

14. APPLICABLE LAW AND JURISDICTION

These conditions are governed by and construed in accordance with Spanish law in everything not expressly established.

Where the CLIENT is legally considered a consumer, any dispute that may arise from the provision of the services covered by these Conditions will be submitted to the courts and tribunals with jurisdiction under the legislation in force on consumers and users.

Where the CLIENT acts as a business or professional, the rules of jurisdiction established by the applicable legislation apply.

GENERAL TERMS AND CONDITIONS OF CONTRACT AND TERMS OF USE

These General Conditions of Use and of Contract govern access to and use of the WEBSITE, as well as the booking of activities through the different Sales Channels, such as telephone bookings and, in particular, those made through the WEBSITE www.ibizajetskibeach.com, owned by ALTAIR NÁUTICA S.L.

All access to the WEBSITE is subject to these General Conditions in the version published and in force at the time the User accesses the website.

The User must read and actively accept the General Conditions before contracting the services, as well as any particular conditions that may supplement, modify or replace the General Conditions in relation to certain services.

The User declares that:

They are of legal age and have the legal capacity to purchase the services offered.
The data provided is true, complete and accurate.
They have read and understood these conditions.
They assume the obligations corresponding to them under these conditions.

In the case of services or activities that may be booked or enjoyed by minors under the conditions established by ALTAIR NÁUTICA S.L., the corresponding authorisations and requirements must be met.

REGISTRATION – USER

When using the WEBSITE, the user must provide the data needed to correctly manage the booking, including name, email address and telephone number.

In order to book the different products and services offered by www.ibizajetskibeach.com, the user must accept the Privacy Policy and these General Conditions.

All the information supplied must be true, complete and accurate.

The data will be processed in accordance with the General Data Protection Regulation (EU) 2016/679 and Spanish Organic Law 3/2018.

Personal data may be processed in order to:

Manage bookings.
Manage services.
Send communications relating to the booking.
Manage payments.
Invoicing and accounting.
Customer service.
Handle incidents.
Comply with legal obligations.
Where appropriate, send commercial communications when there is a valid legal basis for doing so.

During the purchase process and before it is completed, the User will have all the information on the full final price, including taxes, discounts and any applicable additional costs.

The User is responsible for correctly providing their personal data and the data needed for the booking.

All bookings made through the WEBSITE are automatically recorded and filed in the corresponding system.

The system automatically sends the CLIENT’s email address the booking information together with the booking reference and the instructions needed to take part in the activity.

Bookings may require different payment methods, availability or advance-booking conditions depending on the activity contracted.

The data entered by the User must be true and belong to them, especially the data relating to the means of payment.

The prices of the activities are those published on the website at the time the booking is made.

Prices may vary depending on:

SELF-DRIVE JET SKI RENTAL

ALTAIR NÁUTICA S.L. offers self-drive jet ski rental for clients who hold the required nautical qualification.

The options currently published include:

1 hour — €200 per jet ski.

2 hours — €350 per jet ski.

4 hours — €450 per jet ski.

The price includes one tank of fuel.

The service is provided without an accompanying instructor.

The corresponding nautical licence or qualification is compulsory.

The rental includes the corresponding civil liability insurance.

The rental requires a security deposit of between €1,000 and €2,000 per jet ski, the exact amount of which depends on the duration and the particular conditions of the booking.

AVAILABILITY AND DURATION OF OFFERS AND PROMOTIONS

The duration of campaigns relating to possible offers varies depending on their characteristics.

Each offer may have a specific duration and/or a maximum number of units available.

Its availability may be determined by the validity period, by units running out or by any other condition indicated in the promotion.

Each offer contains, where appropriate, the relevant information on its validity and conditions.

METHODS OF PAYMENT

When the booking is made, 100% of the activity may be charged, unless another condition is expressly indicated during the booking process.

At ALTAIR NÁUTICA S.L. payment may be made by credit or debit card through the payment platforms enabled in the booking process.

Platforms such as Redsys/CaixaBank and Stripe may currently be used, depending on the booking system used.

The payment platforms apply their own security and authentication protocols.

ELECTRONIC INVOICING

Users who make a purchase and wish to receive an invoice must request it by email at:

This service involves no additional cost for the User.

The CLIENT must provide the tax details needed to issue the invoice correctly.

LIMITATION OF LIABILITY

ALTAIR NÁUTICA S.L. offers different leisure and sports activities that may require certain physical and safety conditions.

It is the User’s responsibility to inform ALTAIR NÁUTICA S.L. of any circumstance that may pose a risk to themselves or to third parties during the activity.

ALTAIR NÁUTICA S.L. may refuse a person’s participation when there are objective reasons relating to the safety of the activity.

It is the CLIENT’s responsibility to correctly locate the departure point and to contact ALTAIR NÁUTICA S.L. with any query.

The User must be punctual and, as a general rule, must arrive approximately 20 minutes before the scheduled time, unless otherwise indicated in the booking.

If the User arrives late or is not at the agreed point, they may lose the activity without any right to a refund of the amount paid where the impossibility of carrying it out is attributable to the CLIENT.

ALTAIR NÁUTICA S.L. is not responsible for weather conditions or other force majeure circumstances beyond its control.

ALTAIR NÁUTICA S.L. is not liable for the loss of or damage to Users’ personal belongings during the activities, unless there is legally enforceable liability.

Nor is it liable for damage suffered by Users when they have acted recklessly, without due care or in disregard of the instructions and guidelines given by the instructors.

In adventure activities, Users accept the risks inherent to their nature, without prejudice to the rights to which they are legally entitled.

ALTAIR NÁUTICA S.L. holds the insurance corresponding to the activities contracted, including civil liability insurance and, where appropriate, accident insurance, within the limits, cover, exclusions and conditions of the respective policies.

SPECIFIC LIABILITY IN SELF-DRIVE RENTAL

In self-drive rental, the rider is responsible for the jet ski throughout the entire period between its delivery and its return.

The rider is liable, under the terms permitted by the applicable legislation, for damage arising from:

Improper use.
Negligence.
Recklessness.
Reckless riding.
Failure to follow the instructions.
Navigation in prohibited or risk areas.
Groundings.
Running aground.
Collisions.
Damage to the engine.
Damage to the hull.
Damage to the propeller.
Damage to the turbine.
Damage to the propulsion system.
Loss of or damage to accessories.
Loss or abandonment of the jet ski.
Unauthorised assignment to third parties.

The security deposit established for the rental may be used to cover the amounts payable under these conditions.

When the damage or costs exceed the security deposit, ALTAIR NÁUTICA S.L. may claim the additional amounts to which it is legally entitled.

The security deposit will be returned once the jet ski has been checked, provided that there is no damage, cost or breach attributable to the CLIENT.

SAFETY CONDITIONS

All participants must follow the instructions given by the instructors and by the staff of ALTAIR NÁUTICA S.L.

It is prohibited to:

Ride under the influence of alcohol or drugs.
Perform dangerous manoeuvres.
Disregard safety instructions.
Navigate in prohibited areas.
Endanger other people.
Use the jet ski in a way other than that intended.

ALTAIR NÁUTICA S.L. may end an activity when a participant’s behaviour may put at risk their own safety, that of third parties, that of the staff or that of the vessel.

When the cause is attributable to the CLIENT, early termination may entail the loss of the right to a refund, without prejudice to legally recognised rights.

INDUSTRIAL AND INTELLECTUAL PROPERTY

This WEBSITE is owned by ALTAIR NÁUTICA S.L.

The intellectual property rights and the rights of exploitation and reproduction of this WEBSITE, its pages, screens, information, appearance, design and contents belong to their legitimate owners.

The trade name IBIZA JET SKI BEACH, as well as its names, designs, logos, photographs, contents and graphic elements used on the website, are protected by the applicable regulations.

Any improper use by persons other than the legitimate owner and without express consent may be pursued through the legal means available under Spanish and/or EU law.

Third-party intellectual property rights and trademarks, where these exist, must be respected by all users.

ALTAIR NÁUTICA S.L. reserves the right to modify, suspend, cancel or restrict the contents of the WEBSITE, its links or the information obtained through it.

ALTAIR NÁUTICA S.L. accepts no liability for the incorrect use of the WEBSITE or its contents by the user when such use is contrary to these conditions or to the applicable legislation.

AUDIOVISUAL MATERIAL

The request will be handled in accordance with the applicable regulations.

JURISDICTION

In the event of a dispute between ALTAIR NÁUTICA S.L. and a User who is a consumer, the competent courts are those corresponding under the legislation in force on consumers and users.

Where the User acts as a business or professional, the rules of jurisdiction established by the applicable legislation apply.
