Introduction

This contractual document shall govern the General Terms and Conditions for the contracting of services (hereinafter, “the Conditions”) through the website ibizajetskibeach.com, owned by ALTAIR NAUTICA SL under the trading name of , hereinafter ALTAIR NAUTICA SL, whose contact details also appear in the Legal Notice on this Website.

These Conditions shall remain published on the website for the CLIENT to reproduce and save as confirmation of the contract, and may be modified at any time by ALTAIR NAUTICA SL. It is the CLIENT’s responsibility to read them periodically, as those in force at the time of placing orders shall apply.

Contracts shall not be subject to any formality, except in the cases expressly indicated in the Civil and Commercial Codes and in this or other special laws.

Acceptance of this document implies that the CLIENT:

  • Has read, understands and comprehends what is set out herein.
  • Is a person with sufficient capacity to contract.
  • Accepts all the obligations set out herein.

These conditions shall have an indefinite period of validity and shall apply to all contracts entered into through the ALTAIR NAUTICA SL website.

ALTAIR NAUTICA SL informs you that the business is responsible and aware of the applicable legislation, and reserves the right to unilaterally modify the conditions, without this affecting the terms and conditions that were implemented prior to the modification.

Identity of the contracting parties

On one hand, ALTAIR NAUTICA SL, the PROVIDER of the services contracted by the CLIENT, is ALTAIR NAUTICA SL, with registered address at Calle Sant Jaime, Nº39 4-1, – 07840 Santa Eulalia Del Rio (Illes Balears), NIF B07820509 and customer/USER service telephone number 633750663.

And on the other, the CLIENT, registered on the website with a username and password, for the use and custody of which they bear full responsibility, and who is responsible for the accuracy of the personal data provided to ALTAIR NAUTICA SL.

Subject matter of the contract

The purpose of this contract is to regulate the contractual sale and purchase relationship arising between ALTAIR NAUTICA SL and the CLIENT at the moment the CLIENT accepts the relevant box during the online contracting process.

The contractual sale and purchase relationship involves the delivery, in exchange for a specific price publicly displayed on the website, of a specific service.

Correction of data

When the CLIENT identifies errors in data published on the website or in documents generated by the contractual relationship, they may notify this to info@ibizajetskibeach.com so that ALTAIR NAUTICA SL may correct them as soon as possible.

The CLIENT may keep their details up to date by accessing their user account.

Contracting procedure

In order to access the services offered by ALTAIR NAUTICA SL, the CLIENT must be of legal age and register on the website by creating a user account. To do so, the CLIENT must freely and voluntarily provide the personal data required of them, which will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April 2016 (GDPR), on the protection of natural persons with regard to the processing of personal data and the free movement of such data, and Organic Law 3/2018 of 5 December (LOPDGDD), on the protection of personal data, as detailed in the Legal Notice and Privacy Policy of this website.

The CLIENT shall select a username and password, undertaking to make diligent use of them and not to make them available to third parties, and to notify ALTAIR NAUTICA SL of their loss or theft or of any possible access by an unauthorised third party, so that it may proceed to immediate blocking.

Once the user account has been created, you are informed that, in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), the contracting procedure will follow these steps:

1. GENERAL TERMS OF CONTRACT

Unless otherwise stipulated in writing, placing an order with ALTAIR NAUTICA SL shall constitute acceptance by the CLIENT of these legal conditions. No stipulation made by the CLIENT may differ from those of ALTAIR NAUTICA SL unless expressly accepted in advance and in writing by ALTAIR NAUTICA SL.

2. ACTIVATION OF SERVICES

ALTAIR NAUTICA SL will not activate any service until it has verified that payment has been made.

As the order does not involve the physical delivery of any product, with contracted services being downloaded or activated directly from the Website, ALTAIR NAUTICA SL will inform the CLIENT in advance of the procedure to follow to carry out this download or activation.

Failure to perform the distance contract

In the case of the provision of a service, it will be available from the moment the CLIENT has made payment for it and may be downloaded or activated in accordance with ALTAIR NAUTICA SL’s conditions.

In the event that the contract does not involve the physical delivery of any product, but rather the activation of a download on a website, ALTAIR NAUTICA SL will inform the CLIENT in advance of the procedure to follow to carry out this download.

In the event that the contract cannot be performed because the contracted service is not available within the expected timeframe, the CLIENT will be informed of the unavailability and shall be entitled to cancel the order and receive a full refund of the total amount paid at no cost, without any liability for damages being attributable to ALTAIR NAUTICA SL.

In the event of unjustified delay on the part of ALTAIR NAUTICA SL in refunding the total amount, the CLIENT may claim payment of double the amount owed, without prejudice to their right to be compensated for damages suffered in excess of that amount.

ALTAIR NAUTICA SL shall accept no liability where the download or activation of the service fails to take place due to the information provided by the CLIENT being false, inaccurate or incomplete.

The provision of the service shall be considered completed at the moment the CLIENT has downloaded or activated the service.

3. RIGHT OF WITHDRAWAL

The CLIENT has a period of fourteen calendar days, counted from the date of receipt of the product or from the conclusion of the service contract, to exercise the right of withdrawal, regulated in Article 102 of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, hereinafter RDL 1/2007. If ALTAIR NAUTICA SL fails to meet the obligation to provide information and documentation regarding the right of withdrawal, the period for exercising it shall end twelve months after the expiry date of the initial withdrawal period, in accordance with Article 105 of RDL 1/2007.

The right of withdrawal shall not apply to the contracts referred to and listed in Article 103 of RDL 1/2007, which are set out here.

Any return must be communicated to ALTAIR NAUTICA SL, requesting a return number via the form provided for this purpose, or by email to info@ibizajetskibeach.com, indicating the corresponding invoice or order number.

4. COMPLAINTS AND ONLINE DISPUTE RESOLUTION

Any complaint that the CLIENT considers appropriate will be addressed as soon as possible and may be submitted to the following contact details:

Online Dispute Resolution

In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free-access platform for the online resolution of disputes between the CLIENT and ALTAIR NAUTICA SL, without the need to go to court, through the intervention of a third party, known as a Dispute Resolution Body, which acts as an intermediary between both parties. This body is neutral and will communicate with both parties to reach an agreement, and may ultimately suggest and/or impose a solution to the dispute.

5. FORCE MAJEURE

The parties shall not be liable for any failure due to force majeure. Performance of the obligation shall be deferred until the force majeure event ceases.

The activity is affected by weather conditions (rain, weather alerts, sea state and rescue authority directives, etc.) as well as social circumstances (demonstrations, strikes, public holidays, etc.) beyond our control; accordingly, Altair Náutica S.L. may make slight modifications to the content of bookings when, due to such unforeseen and unforeseeable circumstances, the activities and timetables cannot be carried out in the exact form set out in the online booking offer. In such cases, providers will endeavour to provide the service in the best possible way, substituting services that cannot be enjoyed with others of similar purpose and cost.

6. SCOPE OF CONTRACT

The CLIENT may not assign, transfer or transmit the rights, responsibilities and obligations contracted in the sale.

If any stipulation of these conditions is considered null and void or unenforceable, the validity, legality and enforceability of the remainder shall not be affected in any way, nor shall they be modified in any manner.

The CLIENT declares to have read, to know and to accept these Conditions in their entirety.

7. GENERAL TERMS OF THE OFFER

All sales made by ALTAIR NAUTICA SL shall be understood to be subject to these Conditions.

No modification, alteration or agreement contrary to ALTAIR NAUTICA SL’s Commercial Proposal or to what is stipulated herein shall take effect, unless expressly agreed in writing and signed by ALTAIR NAUTICA SL, in which case such particular agreements shall prevail.

Given the continuous technical advances and improvements in services, ALTAIR NAUTICA SL reserves the right to modify its specifications with respect to the information provided in its advertising, as long as this does not affect the value of the services offered. Such modifications shall also be valid in the event that, for any reason, the possibility of supplying the services offered is affected.

8. PRICE AND VALIDITY PERIOD OF THE OFFER

The prices indicated for each service include Value Added Tax (VAT) or other taxes that may be applicable. These prices, unless expressly stated otherwise, do not include shipping or communication costs, handling, packaging, shipment insurance or any other additional services ancillary to the purchased service.

The prices applicable to each service are those published on the website and are expressed in EUROS. The CLIENT accepts that the economic value of some services may vary in real time.

Before making a purchase, you may check online all the details of the quote: services, quantities, price, availability, charges, discounts, taxes and the total amount of the purchase. Prices may change daily until the order is placed.

Once the order has been placed, prices will be maintained both if the service is available and if it is not.

Every payment made to ALTAIR NAUTICA SL entails the issuance of an invoice in the name of the registered CLIENT or the company name they indicated when placing the order. This invoice may be requested by email at info@ibizajetskibeach.com and sent in PDF format to the email address provided by the CLIENT, provided they have given their express consent to receive it, and they are informed that they may revoke such consent at any time by notifying ALTAIR NAUTICA SL through any of the means made available to them.

9. SHIPPING COSTS

There are no shipping costs.

10. PAYMENT METHODS, CHARGES AND DISCOUNTS

ALTAIR NAUTICA SL is responsible for financial transactions and offers the following methods for making payment for an order:

  • Credit or debit card

The CLIENT may use a discount voucher immediately before finalising the purchase, if they have received one from ALTAIR NAUTICA SL.
When confirming the booking, 100% of the activity cost will be charged; if cancelled within the permitted timeframes, a full or partial refund will be given depending on whether the cancellation is subject to a penalty (we recommend reading the conditions carefully).

Security measures

The website uses generally accepted industry information security techniques, such as SSL, data entered on a secure page, firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorised access to data. To achieve these purposes, the CLIENT agrees that ALTAIR NAUTICA SL may obtain data for the purposes of corresponding authentication of access controls.

ALTAIR NAUTICA SL undertakes not to permit any transaction that is or is considered illegal by credit card companies or the acquiring bank, or that could or has the potential to damage their goodwill or negatively influence them.

The following activities are prohibited under card scheme programmes: the sale or offer of a product or service that does not comply with all laws applicable to the Buyer, Issuing Bank, Merchant or Card Holder or Holders.

11. PURCHASE PROCESS

Basket (quote simulation)

Any service from our catalogue may be added to the basket. The basket will show only the selected services, quantity, price and total amount. Once the basket has been saved, taxes, charges and discounts will be calculated based on the information entered.

Baskets have no administrative binding, they are simply a section where a quote can be simulated without any commitment on either side.

From the basket, an order can be placed by following the steps below for correct completion:

  1. Verification of billing details.
  2. Verification of the method of service delivery (download, activation, etc.).
  3. Selection of payment method.
  4. Placing the order (purchase).

Once the order has been processed, the system immediately sends an email to the ALTAIR NAUTICA SL management department and another to the CLIENT’s email address confirming that the order has been placed.

Orders (purchase requests)

Within a maximum of 24 hours on working days, an email will be sent to the CLIENT confirming the order status and the approximate download and/or activation date.

12. SEVERANCE AND SUSPENSION OR TERMINATION OF CONTRACT

If any of these terms and conditions is considered illegal, null and void or unenforceable for any reason, that condition shall be deemed severable and shall not affect the validity and enforceability of any of the remaining conditions.

ALTAIR NAUTICA SL may, without prior notice, suspend or terminate the CLIENT’s access to its services, in whole or in part, for any valid reason, including, without limitation, where the CLIENT fails to comply with or follow any of the obligations set out in this document or any applicable legal provision, licence, regulation, directive, code of practice or usage policies.

When exercising any of its rights or powers under this Clause, such exercise shall not prejudice or affect the exercise of any other right, power or remedy that may be available to it.

13. GUARANTEES AND RETURNS

Guarantees shall be governed by the provisions of the Title relating to “Guarantees and after-sales services” of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, which can be accessed by clicking here.

Booking modifications

Clients shall incur no additional cost for modifying their booking date to a different date through verified means, provided this is done at least 48 hours before the booking date and spaces are available. To make such a modification, clients may contact the activity provider Altair Náutica S.L. at the following email address: info@ibizajetskibeach.com.

Booking cancellation

Cancellation of bookings for the various activities offered shall be subject to this policy and general terms and to any particular conditions that may be established at the time of payment. In general, Altair Náutica S.L. permits cancellation at no cost to the Client;

Up to 14 days before the contracted activity, the Client may cancel and receive a full refund of the amount paid as a booking deposit. However, in accordance with the provisions of Article 103 of Law 3/2014 of 27 March, amending the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007 of 16 November, the right of withdrawal is excluded in these cases as it involves the provision of a service whose execution is deemed to have commenced for administrative, logistical and material reasons.

If cancelled within the last 72 hours, a penalty of 50% shall apply as detailed in the offer.

In any event, cancellation within the last 24 hours shall not entitle the client to any refund of the amount paid, and 100% of the activity price will be charged.

For group bookings of more than 5 jet skis, cancellation is free provided it is made at least 14 days before the activity date. However, cancellation within the last 72 hours will result in the loss of 50% of the amount paid per booking. If clients do not attend the activity or cancel within the last 24 hours, 100% of the activity price will be charged.

If any activity has a particular cancellation policy, this will be stated in the offer, during the booking process and in the booking confirmation, voucher or coupon.

14. APPLICABLE LAW AND JURISDICTION

These conditions shall be governed and interpreted in accordance with Spanish law in all matters not expressly established herein.

Any dispute arising from the provision of products or services subject to these Conditions shall be submitted to the courts and tribunals of the CLIENT’s place of domicile, the place of performance of the obligation, or the place where the property is situated if it is immovable.

GENERAL TERMS AND CONDITIONS OF CONTRACT AND TERMS OF USE

These General Terms of Use and Contract (hereinafter, “the General Conditions”) govern access to and use of the WEBSITE as well as the booking of activities through the various “Sales Channels” such as telephone bookings and, in particular, those formalised through the Website www.ibizajetskibeach.com, owned by Altair Náutica S.L.

All access to this Website www.ibizajetskibeach.com is subject to each and every one of these General Conditions in the version published and in force at the time the User accesses www.ibizajetskibeach.com.

User registration is not mandatory; however, any user who contracts services provided by Altair Náutica S.L. must first read and actively accept the General Conditions before using the Website, as well as any particular conditions that may supplement, modify or replace the General Conditions in relation to certain services and content on www.ibizajetskibeach.com, as these may have been modified since the last time they accessed it.

The User declares that:

They are of legal age and have the legal capacity to purchase the services offered through www.ibizajetskibeach.com.

In the event of a contract being entered into by a minor, Altair Náutica S.L. shall not be liable in any case, and the minor, parents or guardians must assume any costs that this may give rise to.

Use of the WEBSITE constitutes an agreement between the user and Altair Náutica S.L., by which the user expressly accepts full and unreserved adhesion to each and every one of the General Conditions published by Altair Náutica S.L. at the very moment the User accesses this portal, especially those established regarding the limitation of liability of both Altair Náutica S.L. and any provider of tourism or excursion services. The User must therefore read the General Conditions carefully on each occasion they intend to use the WEBSITE, as they may have been modified since the last time they accessed it.

Altair Náutica S.L. understands that those who use its WEBSITE, booking the various activities, meet the legal requirements relating to the capacity to enter into these contracts and that, in doing so, they tacitly accept being bound by the terms and conditions set out in the following sections.

By accepting these General Conditions, the User states:

That they have read, understand and comprehend what is set out herein.

That, if they intend to contract any product and/or service, they have sufficient capacity to do so.

That they accept all the obligations set out herein.

REGISTRATION – USER

When using the WEBSITE www.ibizajetskibeach.com, the user must always provide a name, an email address and a telephone number.

In order to contract the various products and services offered by www.ibizajetskibeach.com and to receive newsletters with information about offers, you must accept the privacy policy and these general conditions, and in doing so you declare that all information provided at the time of registration is true, complete and accurate, and that in accordance with Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights and Regulation (EU) 2016/679 of 27 April 2016 on the Protection of Personal Data, you consent to its processing.

The person who registers and/or contracts services offered on the WEBSITE expressly authorises Altair Náutica S.L. to include their data in an automated file called “CUSTOMERS” and/or in its record of processing activities in accordance with Article 30 of Regulation (EU) 2016/679 of 27 April 2016 on the Protection of Personal Data, for the personal data appearing in the form fields as necessary for the proper provision of its services, the collection of which is for the purpose of:

Developing services related to the intermediation in the marketing of the said services. Specifically: commercial, administrative, logistical and related management.

Verifying credit cards and other types of payment cards.

Complying with the accounting, invoicing and audit requirements of www.ibizajetskibeach.com.

Keeping you informed of offers and promotions similar to those contracted.

PURCHASE AND BOOKING PROCEDURE

During the purchase process and always before it is completed, the User will have all information available relating to the full final price, including taxes, breaking down, where applicable, the amount of any increments or discounts applicable to the offer and any additional costs charged to the User; the User is responsible for providing their details correctly, including their personal data and banking details required by the system.

All bookings made on our WEBSITE are recorded and therefore automatically archived in our system.

In addition, the system automatically sends the client’s email address the details of their booking together with their booking reference number and all instructions regarding the payment method and submission of activity documentation. A contact telephone number is always provided to resolve any queries or questions.

Altair Náutica S.L. provides a fast, secure online booking method, available 24 hours a day. Bookings are made through the website www.ibizajetskibeach.com. Given the variety of activities, different payment methods or different advance notice periods may be required to make a booking depending on demand and availability for that activity.

The data entered by the User must be true and in their name, especially data relating to payment methods.

Exceptionally, in the event that it is not possible to book online for the requested date, Altair Náutica S.L. is available to Clients via info@ibizajetskibeach.com to resolve the matter or provide other alternatives of interest. Likewise, in the event that it is not possible to make the booking online, you may contact the number +34 645 871 590 through which we will endeavour to make the booking by telephone.

Cancellation of bookings for the various activities offered shall be subject to this policy and general terms and to any particular conditions that may be established at the time of payment. In general, Altair Náutica S.L. permits cancellation at no cost to the Client;

Withdrawal: you may withdraw from the contract within 14 days of its conclusion. Such withdrawal is free of charge and does not entail any penalty, and must be communicated as promptly as possible.

Refund: the refund will be made immediately and in the event of unjustified delay, double the amount will be refunded.

Altair Náutica S.L. may cancel a booking at any time for reasons of force majeure and always with user safety in mind, with the amount paid being automatically refunded and the User having no right to claim any additional amount (taxi, travel to pick-up point or activity location). In such cases, Altair Náutica S.L. will notify the User as quickly as possible via the contact details indicated in their booking. It is the User’s responsibility to be reachable through these means.

AVAILABILITY AND DURATION OF OFFERS AND PROMOTIONS

The duration of campaigns relating to possible offers will vary depending on their characteristics and will have a set duration and maximum number of units available for each, meaning that availability may be determined by the expiry of the time period or by units running out. Each possible offer will contain relevant information about its validity and expiry date.

PAYMENT METHODS

When confirming the booking, 100% of the activity cost will be charged; if cancelled within the permitted timeframes, a full or partial refund will be given depending on whether the cancellation is subject to a penalty (we recommend reading the conditions carefully).

LIMITATION OF LIABILITY

Altair Náutica S.L. offers on its website a wide variety of leisure and sports activities that require Users to be in full physical and psychological health. It is the User’s responsibility to inform Altair Náutica S.L. of any health circumstances that could pose a risk to the User or third parties during the activity, and Altair Náutica S.L. is entitled to refuse the booking. It is the client’s responsibility to locate the activity departure point and to call or contact Altair Náutica S.L. if they have any questions. The User must always be punctual, and as a general rule it is advisable to arrive 15 to 20 minutes before the scheduled time. If the User arrives late or is not at the agreed meeting point, they will not be entitled to any refund of amounts previously paid, nor for any costs incurred.

Altair Náutica S.L. shall not be liable for weather conditions or any other force majeure circumstances beyond the control of Altair Náutica S.L., nor does it accept responsibility for the loss of Users’ personal effects during activities. It shall also not be liable for injuries suffered by Users or their death during the various activities where these have resulted from reckless behaviour, failure to exercise due diligence, or failure to follow the instructions and guidelines established by the activity instructors. Likewise, in the case of adventure activities, Users accept under their own responsibility, upon contracting these activities, any risks they and minors in their custody may incur during their participation. Accordingly, Altair Náutica S.L. holds public liability insurance as well as accident insurance for each contracted activity, and its liability is therefore covered within the legal terms of those contracts.

Altair Náutica S.L. makes every effort to update, maintain and operate its WEBSITE, offering Users this website as a tool for obtaining services; however, Altair Náutica S.L. cannot guarantee the absence of technical failures, complete security of the web service, or that it will be operational 24 hours a day, seven days a week at all times.

If, due to force majeure (including by way of example, social, political or economic unrest, strikes or any type of instability affecting public safety in general or that of the User in particular), deficiencies arise in bookings, confirmations and/or the performance of any services contracted through Altair Náutica S.L., and in situations that are not foreseeable or avoidable by Altair Náutica S.L., or if the performance of any of the agreed provisions is even impossible, Altair Náutica S.L. and/or Altair Náutica S.L.’s partner companies are excluded from any obligation to pay compensation, in accordance with applicable legal provisions.

JURISDICTION

In the event of a dispute between Altair Náutica S.L. and the User, the courts of the consumer’s place of domicile shall have jurisdiction.
